Terms of Service
WideVista ("Company"/"we"/"us") owns and runs the game and website at widevista.com, along with any related services (together called the "Services"). Take a moment to read through these terms of use ("Terms"). Using the Services means you're accepting these Terms. If you don't agree with them, don't use the Services or any of its features or content. We can change these Terms, and if you keep using the Services after we make changes, that means you're accepting the updated version. Any new features we add will follow these Terms unless we say otherwise. Check back here once in a while since we update this page from time to time.
EXPLORATION & CONDUCT RULES
The Services are built on community, fairness, integrity and exploration so please follow the rules and have fun. This part of the Terms explains the rules around setting up accounts, in-game features, and behavior we don't allow. User Accounts. You're limited to one account per platform or device, and we recommend keeping just one account across everything. If you decide to run multiple accounts on different devices anyway, they absolutely cannot interact with each other in any way. If we catch them interacting, we might ban, reset, or penalize one or more of those accounts. Virtual Goods Transfers & Account Sales. Anything you get in the Game (virtual currencies and virtual goods) can't be sold, traded, or turned into real money. Trying to do this breaks these Terms and could get your account permanently banned plus legal trouble. When you buy virtual goods and currencies, that's final—no refunds. Virtual currency and goods have no real-world value. We have complete control to manage, regulate, change, or delete virtual currency and goods whenever we want, and we're not responsible to you for how we use that power. You're responsible for all charges on your account, whether you made them or someone else who got access to your account did. If your account gets terminated or suspended for any reason, you lose all your virtual goods and currencies. General Conduct & Prohibited Acts. Some things just aren't allowed. You cannot: Use the Games if you're under 13. Pick a character name that's disrespectful to other users. Use Bots, Auto-Clickers, Hacks or Exploits in the Games or do anything else that breaks our Rules and Policies. Tell other players they're cheating through any in-game communication channel. That covers forums, player comment walls, status messages, and chat. If you actually suspect cheating and have real evidence, contact us directly through our contact form instead. Upload, post, email, send or otherwise share: on the Services any material that's unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, sexually-explicit, libelous, invasive of someone's privacy, hateful, or racially or ethnically objectionable, or that encourages criminal behavior, creates legal liability, violates any law, or is otherwise objectionable. anything that infringes intellectual or other property rights of anyone (including privacy and publicity rights). anything you don't have the right to share. anything false or misleading or that gives a wrong impression on purpose, including impersonating another user or our staff or anything that could hurt or harm minors. Interfere with or disrupt the Services (including security features) or the servers or networks connected to them, or ignore any requirements, procedures, policies or regulations of those networks, or try to probe, scan, test vulnerabilities, breach or get around any security or authentication measures. Break any applicable local, state, national or international law or regulation, whether you mean to or not. Resell the Services or any of its content or access to it. Do anything else that violates these Terms. Action by Company. Any of these prohibited activities can get your post or thread deleted (chat, forum, or profile walls) and can result in your account being temporarily or permanently limited, blocked, suspended or terminated depending on how serious it is, or whatever other penalties we think fit. Availability. We can change, pause, or stop the Services anytime and for any reason without warning. The Services might be down sometimes due to maintenance, equipment issues, or other reasons. We might add to or update the information and materials on the Services without telling you. We reserve the right to change and update the Games whenever we want or think it's necessary.
INTELLECTUAL PROPERTY, OWNERSHIP AND CONTENT RULES
We care about protecting intellectual property. This section explains who owns what and the rules around content and technology used in the Services. Copyright and Trademark Information. The Services and everything on it are owned by Company and its licensors and protected by copyright law, trademark law, international agreements and other IP laws. All Company product names and logos are our trademarks or registered trademarks. Other company and product names and logos are trademarks or registered trademarks of their owners in certain countries. Nothing on the Services should be interpreted as granting any license or right to use the Services or its materials through framing or any other method, unless Company gives written permission first. Feedback & Suggestions. If you send us suggestions, comments or other feedback ("Feedback"), we might use it in the Services or in other Company products or services. By doing this you agree that: (a) we're not bound by confidentiality regarding the Feedback, (b) the Feedback isn't confidential or proprietary to you or anyone else and you have the right to share it with WideVista, (c) Company including all successors and assigns can freely use, reproduce, publicize, license, distribute, and commercialize the Feedback, and (d) you won't get any payment or reimbursement of any kind from us or other users. Content. All information, data, messages or materials on the Services, whether posted publicly or sent privately, is the responsibility of whoever posts or sends it. We don't control this content and can't guarantee it's accurate, complete or good quality. Users understand that using the Services means you might run into offensive, indecent or objectionable materials. Partner Terms of Service. We follow the terms of service of our platform partners like Facebook, Apple, Google, and Android. You've read and agree that you follow the terms of service for whichever platform you're using to access our Services. Be aware of their rules and don't break them because it could get you banned.
LIABILITY AND RISK TERMS
To offer the Services, we have to limit how responsible we are, as spelled out here. Release. Since we don't supervise or control how members interact with each other or with other people or companies, and we don't control credit card companies or payment processors, and we can't verify the real identity or age of users, and we have little to no control over the quality, safety, morality, legality, truthfulness or accuracy of different parts of the Services, you agree you take all the risk. You release Company and its officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners from any claims, demands, and damages connected to your use of the Services or any third party transactions. You also give up any rights you'd have under any law that would limit what you can release or waive. DISCLAIMER. Everything provided through the Services comes "as is." We don't represent, warrant or claim that: (I) the information or materials are correct, accurate, reliable or complete; (II) the functions will work without interruption or errors; (III) defects will get fixed, or (IV) the Services or servers are free of viruses or harmful stuff. We specifically disclaim all representations, warranties and conditions, whether express, implied, statutory, by trade usage, course of dealing or any other way, including any implied warranties of merchantability, non-infringement, title, satisfactory quality or fitness for a particular purpose. Anything you download or get through the Services is your own risk and you're solely responsible for any damage to your computer, lost data, or any other loss from downloading or using such material. We don't warrant, endorse, guarantee or take responsibility for any content or materials on the Services, any products or services advertised or offered by third parties through the Services, or any services you can reach from links on the Services or in banners or advertising, and WideVista isn't a party to any transaction you make with any third party. LIMITATION OF LIABILITY. To the fullest extent allowed by law, Company isn't liable for any indirect, incidental, special, consequential, exemplary or other damages, including damages from (I) your use or inability to use the Services or any information or materials on it, (II) the cost of getting substitute goods, data, information or services, (III) errors, mistakes, or inaccuracies in the materials, (IV) any property damage from your use of the Services, any bugs, viruses, trojan horses, or files or data that could harm your computer or communication equipment or that got sent through the Services, or any other loss or damage from your use of the Services. These limits apply even if we've been told the damage could happen. These limits apply to the fullest extent the law allows in your jurisdiction. INDEMNIFICATION. You will indemnify and hold Company and its affiliates, officers, agents, platform partners and employees harmless from all claims, threats, actions, proceedings, demands, damages, losses, obligations, costs, and expenses including reasonable attorneys' fees from any third party due to materials you submitted, posted, sent or made available through the Services, any violation of these Terms by you, or any violation of anyone else's rights by you (including intellectual property rights and rights of publicity, personality or privacy).

We're not responsible for what's on those linked services. Third-party services and anything you reach from the Services are subject to their own terms and conditions, and you have to find out what those are and follow them. Termination. We can immediately cut off your access to the Services or parts of it under certain circumstances and without warning. We can do this for reasons like (a) you breaking these Terms or any other agreement with us (including not paying fees), (b) law enforcement or government agencies asking us to, (c) you asking us to, (d) us stopping or significantly changing the Services or any part of it, (e) unexpected technical, security or legal issues, and/or (f) you being involved in fraudulent or illegal activities directly or indirectly. When we terminate your access, we might remove some or all of the materials you uploaded. You understand that all terminations are our decision alone and we're not liable to you or anyone else for terminating your access. Once your account is terminated or you cancel it, you don't get a refund and you lose access to Site Content. When we terminate these Terms, that's on top of any other rights we might have. Security. Information sent or received over the Internet usually isn't secure and we can't make any promises about the security of communication to or from the website or about whether third parties might intercept your personal or other information. Updates. We can modify, suspend, or discontinue the Services or any part of it anytime, with or without notice. You agree that we won't be liable to you or anyone else for any changes, suspension, or discontinuation. Entire Agreement. These Terms, along with our Privacy Policy and Rules and Policies, make up the whole agreement between us about the Services and everything related to it.
